PopSlice Terms of Service
PopSlice.com, via SemiBig, Inc. (“we”, “us” or “our”), provides its service(s) to users like you (“you” or “your”) under these Terms of Service (“Terms”). When you access PopSlice.com or any of its services, you are agreeing to follow all of the rules in these Terms. We may update these terms at any time without telling you, so be sure to check them out at http://popslice.com/terms/.
General Rules
You have to be at least 18 years old to use PopSlice.com. You also need to be competent to enter into a contract. By using PopSlice.com, you confirm that you are at least 18 years old and that you are competent to enter into a contract. These Terms are a contract between you and SemiBig, Inc. (the awesome company that makes PopSlice.com possible). If anything on PopSlice.com or any affiliated website conflicts with these Terms, these Terms take precedence (they are the supreme law of the PopSlice.com land).
PopSlice.com offers a lot of semi-cool stuff, like general and personalized content, communication tools, content management tools – and we’re adding more every day! In these Terms, we call all of this semi-cool stuff our “services.” All of the services are the proprietary property of SemiBig, Inc.. The services are protected by all kinds of fun laws, like copyright, trade secret, patent and other proprietary rights and laws. You are only allowed to use the services in ways that follow the rules in these Terms.
Temporary Use License
We grant you a non-exclusive, non-transferable and fully cancelable license to use the services, but only if you follow all these Terms. This license is only valid while you are logged into your valid PopSlice.com account from a single computer that accesses the services directly from the PopSlice.com website. Your PopSlice.com account is only valid if you provide a valid name and email address when you register for an account. You must keep this information updated. You agree and promise not to (and will not allow any third party to) copy, display, distribute, lease, loan, modify, rent, sell, transfer, transmit, reverse assemble, reverse engineer or otherwise discover or attempt to discover any source code or any other part of PopSlice.com or the services. You may not assign, sell, sublicense or grant a security interest in or attempt to transfer any right in the services in any way. You may not create any derivative works based on or that in any way commercially exploit PopSlice.com the services. If you do create any derivative works, you agree that those derivative works are our property. Under no circumstances are you allowed to store any service or any part of a service on any computer or other device.
Content Rules
Any information that you or a third party allow, email, post, obtain, submit or transmit to the services, including, but not limited to, text, graphics, pictures, video, audio, links, addresses, data, functionality and any other materials (we’re going to call this stuff “content”) is your responsibility, not ours. Basically, it’s all you. For this reason, we do not guarantee the accuracy, integrity or usefulness of the content available through our services. We do not control your content and we do not have the obligation to review, refuse or remove any content available through our services. We still reserve the right to remove any content available via the service at any time in situations like, but not limited to, abuse of our services, possible infringement of someone else’s rights, privacy concerns, violation of this agreement, complying with the law and assisting law enforcement.
It may be all you, but there is some content that we just don’t allow on PopSlice.com. Such content includes, but is not limited to: content of an illegal nature (like stolen copyrighted material); pornographic, sexually explicit or violent content; pirated software, including cracking programs or cracking program archives and any sites related to pirating activity; content that could be reasonably considered libelous or slanderous; and content with the sole (only) purpose of causing harm or inciting hate.
PopSlice.com and SemiBig, Inc. have the final say as to whether any content violates these Terms.
Service Fees
Only services that are clearly labeled as “free” are free. All other services provided by us are for a fee and you are liable for those fees. You are also liable for any taxes or fees of any kind associated with the services. We are not liable for any taxes or fees. PopSlice.com and SemiBig, Inc. are not obligated to provide or responsible for providing support for the services.
Indemnification
You agree to indemnify us and hold us harmless from any claims resulting from your use, or use of others allowed by you, that damages PopSlice.com or SemiBig, Inc. or its officers, employees, directors, partners, members, employees or agents.
You agree to indemnify us and hold us (PopSlice.com and SemiBig, Inc., including our officers, employees, directors, partners, members, employees and agents) harmless from any claims that arise from any service provided or performed, agreed to be performed or any product used or sold by or to you, your agents, employees or assigns.
You agree to indemnify us and hold us (PopSlice.com and SemiBig, Inc., including our officers, employees, directors, partners, members, employees and agents) harmless from any and all liabilities caused directly or indirectly by you or any person you allow to access the services.
Limited Liability
You agree that we will never be liable for any damages that result from the use or inability to use PopSlice.com or the services. Your exclusive remedy for any and all damages will be no more than the total dollar amount that you paid directly to us.
No Warranties
We do not make any warranties of any kind for the services. Use of the services is at your risk. We do not warrant that service will be uninterrupted or error-free. We disclaim any warranty of merchantability or fitness for a particular purpose. We are not responsible for any damages that result from delays or service interruptions. Any damages for unavailability of the services are limited to a pro-rata portion of the monthly charge that you pay to us, however, if the services are down for maintenance, we will provide notice of the unavailability and no damages will be provided for maintenance unavailability.

We have the right to change these Terms at any time. Every time you use the service, you agree to the current Terms, available at
Termination
We may terminate this agreement at any time, for any reason. Once we tell you that we are terminating our services to you, we have the right to delete all data, files, or other information that is stored in your account for any reason.
